Worker’s Compensation Retaliation
When you are injured on the job, you are immediately put into a very difficult position. You now have to report the injury to your employer, and have your treatment provided by your employer’s insurance company. On top of being injured, many employees in this position immediately become fearful of retaliation by their employer, or that they may be fired.
Employees who are going through a worker’s compensation claim have rights under Florida law. Florida statute 440.205 states:
“No employer shall discharge, threaten to discharge, intimidate or coerce any employee by reason of such employee’s valid claim for compensation of attempt to claim compensation under the workers’ compensation law.”
