Florida Motorcycle Law: What Riders Need to Know

Florida no-fault PIP does not apply to motorcycles. The state’s no-fault statute defines “motor vehicle” as any self-propelled vehicle with four or more wheels under Fla. Stat. § 627.732(3), so two-wheeled bikes fall outside the PIP system. That carve-out cuts both ways. You can’t lean on PIP for the first $10,000 of bills. You also aren’t gated by the no-fault “serious injury” threshold when you go after the at-fault driver for pain and suffering.

Florida changed two rules in March 2023 that affect almost every motorcycle case. Recovery is now barred if a jury finds you more than 50% at fault under Fla. Stat. § 768.81(6). The deadline to file a negligence claim dropped from four years to two under Fla. Stat. § 95.11(4)(a). The 2-year window applies to causes of action accruing on or after the March 24, 2023 effective date per Chapter 2023-15, § 28. Crashes before that date generally still fall under the prior four-year window. Wolf v. Williams (Fla. 5th DCA, Nov. 25, 2024) is the leading appellate authority on HB 837 prospectivity generally.
